funkypool is using a .com extension that is maintained from American registrars, as such it can be seen as an American entity under this law. Therefore the site can be liable under US laws, so they can pull the domain name, sue the site, and order the site to be withdrawn from search engines. (Or that is how I understand it.)
It's more a case of linking to sites that host pirated content rather than swearing etc.
Companies regular search for pirated content. If we're found linking to it, even on an old buried thread, we could be in trouble.
Could you get round this is funkypool was a .co.uk? instead of a .com

Won't matter if they are premium members or non-paying members. If the site gets shut then no one can get on.

Yes, this would evade it. It would be possible that the UK may follow suit though, especially considering the "special relationship". Moving domain is a big problem though, it'd lose years of building up links and bookmarks and branding.
The worst I can envisage would be removing the public forum and chat sections or changing domain. I don't see a reason the site couldn't exist in a new location. Moving a site to a new host and/or domain name takes a few days, and this lost time would be added to premium accounts.

Im lost to be honest, what is this all about? you saying if someone was to swear on the forum that the site could be shut down if someone outside the site seen it.

No, it's about piracy. People posting youtube footie videos for example.
Have a look at the link spinner posted on the first page. Or alternatively just google SOPA.

No, it's about anti-piracy laws being discussed in USA. Basically, if someone were to post links to illegal downloads for software, music or films then the site could be removed from search engine results or shut down. Swearing on the internet is still perfectly legal (for now, anyway)
