The EULA has been retracted, as explained here : http://www.theregister.co.uk/2008/09/04/google_retracts_lousy_chrome_eula_terms/
Basically they just use the same generic EULA for all services, so fair enough.
At the end of the day, anything you post/send/write via the internet is avaliable to be read by those with the necessary access. All gmail does is make clearer that your email will be searched for the purpose of targeted advertising, something that, if you are using AOL, BT Openworld/Sky or Virgin ISP's (in the uk) is also being done by them.
If you want something kept private, the only option is to keep it away from your computer!

I use Chrome as my default browser now.
I regularly use multiple browsers to test funkypool web pages and it has won me over. It has a very minimal feel and a very quick startup. The draggable tab handling is fantastic.
It's not perfect yet - it has crashed a few times and I still need to access another browser for certain websites (eg football streams).

Lots of people, well businesses, are. You're just connected to a massive network after all.
I really like Chrome too, its my secondary browser of choice, and for the same reasons Nick mentions, fast, great design and excellent functionality.
